1. Introduction

These Terms and Conditions govern your access to and use of the Akiba Pay platform, website, mobile application, and related services (collectively referred to as the “Service”).

Akiba Pay provides a digital payment platform designed to help individuals and small businesses receive payments and automatically allocate a portion of those payments into savings.

By accessing or using Akiba Pay, you agree to be bound by these Terms and Conditions. If you do not agree with these terms, you must not use the Service.

2. Definitions

For the purposes of these Terms:

  • “Akiba Pay”, “we”, “our”, or “us” refers to the Akiba Pay platform and its operators.
  • “User”, “you”, or “your” refers to any individual or business that registers for or uses the Service.
  • “Savings Split” refers to the automated allocation of a specified percentage of received payments into a designated savings account.
  • “Primary Account” refers to the account designated by the user to receive the remaining portion of payments after the savings split.

3. Eligibility

To use Akiba Pay services, you must:

  • Provide accurate registration information
  • Have a valid mobile money account or bank account
  • Comply with applicable laws and regulations

Akiba Pay reserves the right to refuse service to anyone who does not meet these requirements.

4. Account Registration

To use the Service, you must create an account and provide certain information including:

  • Full Names
  • Phone Number

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities performed under your account
  • Ensuring your information remains accurate and updated

5. Description of Services

Akiba Pay enables users to:

  • Receive digital payments from customers
  • Automatically split incoming payments
  • Transfer a selected percentage into savings
  • Receive the remaining funds in their primary account

The percentage allocated to savings is determined by the user and may be modified within the platform.

6. Payment Processing

Akiba Pay may integrate with third-party financial service providers including mobile money operators and banks.

Payments processed through Akiba Pay may involve services provided by entities such as: M-pesa, Banks etc

Akiba Pay does not guarantee uninterrupted availability of third-party services.

7. Savings Allocation

When a payment is received:

  • A percentage selected by the user is transferred to the designated Savings Account.
  • The remaining amount is transferred to the Primary Account.

Users acknowledge that:

  • Savings allocations occur automatically.
  • Akiba Pay does not guarantee investment returns on savings.
  • Users may adjust the savings percentage through their account settings.

8. Fees and Charges

Akiba Pay may charge service fees for Payment processing, Withdrawals, Transfers & Other services offered on the platform.

All applicable fees will be communicated within the platform or on the website before transactions are completed.

9. Prohibited Use

Users may not use Akiba Pay for:

  • Fraudulent activities
  • Money laundering
  • Illegal transactions
  • Terrorism financing
  • Any activity that violates applicable laws

Akiba Pay reserves the right to suspend or terminate accounts involved in prohibited activities.

10. Compliance and Regulation

Akiba Pay may be required to comply with financial regulations and anti-money laundering obligations enforced by regulators such as the Central Bank of Kenya.

To comply with such regulations, Akiba Pay may request additional verification documents or temporarily restrict accounts.

11. Account Suspension or Termination

Akiba Pay reserves the right to suspend or terminate accounts if:

  • Users violate these Terms
  • Fraudulent activity is suspected
  • Required verification is not completed
  • Regulatory obligations require suspension

Users may also request account closure by contacting Akiba Pay support.

12. Limitation of Liability

To the maximum extent permitted by law, Akiba Pay shall not be liable for:

  • Loss of profits
  • Indirect or consequential damages
  • Service interruptions caused by third parties
  • Failures of telecommunications or mobile money systems

13. Security

Akiba Pay implements reasonable security measures to protect user accounts and transactions.

However, users are responsible for:

  • Protecting login credentials
  • Not sharing verification codes
  • Reporting suspicious activity immediately

14. Intellectual Property

All content, trademarks, logos, and technology used in the Akiba Pay platform are the property of Akiba Pay or its licensors.

Users may not reproduce, copy, or distribute Akiba Pay intellectual property without written permission.

15. Changes to Terms

Akiba Pay reserves the right to update these Terms and Conditions at any time.

Users will be notified of significant changes through the website, mobile application notification & email or SMS communication

Continued use of the Service constitutes acceptance of the updated Terms.

16. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.
